Like its Canadian counterpart, this work permit category permits specialized knowledge workers and managers to transfer to the United States to work at a US affiliate of their employer in their home country. Processing time can vary depending on the employee’s individual circumstances, for example, the employee’s nationality, or country of residence.

Available to citizens of Canada and Mexico, applicants with job offers who will occupy a number of enumerated professions may apply for work authorization in the United States. Examples of professions covered under this category would be engineers, computer systems analysts, management consultants, and graphic designers, among others. A university degree in an area of study related to the profession is normally required.

Available to individuals with extraordinary ability or achievement, this work authorization category applies to those with extraordinary ability in arts and entertainment, athletics, sciences, business and education. Although it can apply to anyone who excels in their field of specialty, it most commonly applies to artists and athletes who will assume a short term, temporary assignment in the United States.

This option for work authorization is available to outstanding athletes, athletic teams, and entertainment companies, as well as essential support personnel. It differs from the O visa in that eligibility for this category can be based on a team’s accomplishment, rather than an individual’s accomplishments.
